    Investigations and regulatory enquiries from abroad – the challenges for companies doing business in France
    Conducting internal investigations in France and/or responding to foreign regulatory enquiries constitutes a real challenge for all concerned on legal and technical levels.  From a legal standpoint, businesses must ensure compliance with French data protection, criminal and labor law provisions while meeting their obligations under foreign regulations or legal regimes.  Not handled properly, these local law constraints can pose serious barriers to thorough investigations.
    On the other hand, available statistics and anecdotal evidence suggest that losses to businesses and investors from fraud, corruption and accounting abuses remain a significant if often understated problem.  When problems arise or are suspected, how should businesses react?  What tools are available to them to understand the issues and to respond swiftly to any indication of fraud or regulatory enquiry?  How can businesses avoid spending a fortune searching through potentially vast volumes of data for the key documents that are central to any investigation while satisfying themselves that they have preserved what may be necessary?
    Using a case study, AmCham members Debevoise & Plimpton LLP (an international law firm) and FTI Consulting (an independent Global business advisory firm) will aim to guide participants in this seminar through the legal, accounting and technology minefields.

    Michael Ostrove, International Counsel with Debevoise & Plimpton LLP in Paris.  Mr. Ostrove played a senior role in Debevoise & Plimpton’s recently publicized independent investigation of Siemens AG and routinely advises on regulatory investigation issues in France.
    Judith Beckhard Cardoso, Senior Associate with Debevoise & Plimpton LLP in Paris regularly advises U.S. and French clients on data protection and labor law matters.
